All occupants of a property have a duty to maintain the communal back green, although the Council will not normally be able to enforce this unless health and safety issues arise. However, tenancy agreements for rented flats normally require tenants to contribute to the upkeep of the communal back green. The matter should therefore be taken up with tenants and letting agents or landlords, if necessary through the Council’s HMO (House in Multiple Occupation) Helpline (0800 085 4667).
There is no legislation for front gardens to be kept in good order unless health and safety issues arise. However, hedges or shrubs which obstruct the pavement will be dealt with by the City of Edinburgh Council. Instances of obstruction should be reported to the Clarence helpline: 0800 23 23 23.
